§ 1 Scope

(1) The following Terms of Use (hereinafter "Terms") govern the relationship between TRACE Electricity GmbH, Dorothea-Bernstein-Weg 48, 22081 Hamburg, Germany (hereinafter "TRACE") and users of our website at trace-electricity.com (hereinafter "Website"). The domains trace-electricity.de, trace-electricity.ai and trace-electricity.io are redirected to trace-electricity.com and are also subject to these Terms from the redirection onward.

(2) By accessing and using the website, the user accepts these Terms. They apply in the version valid at the time of access.

Section 2. Applicability of Separate Terms for TRACE Products

(1) These Terms do not govern the use of TRACE products. Separate terms apply:

(3) TRACE.Configurator and TRACE.Studio are provided on the basis of individual offers. The "TRACE.Configurator License & Service Agreement" including the Data Processing Agreement pursuant to Article 28 GDPR, which is attached to each offer and becomes legally binding upon customer signature, is decisive.

Section 3. Website Services

(1) The website provides information about TRACE offerings, displays references and team members, and enables contact. It is freely accessible.

(2) The presentation of TRACE products and services on the website does not constitute a binding offer. Orders and contracts are concluded exclusively through the methods described in Section 2.

Section 4. User Obligations and Prohibitions

The user agrees not to misuse the website. In particular, the following are prohibited:

  • using automated systems (bots, scrapers, crawlers) that place an unreasonable load on the servers or systematically extract content;
  • circumventing security mechanisms or access controls of the website;
  • reproducing, distributing or making publicly available content of the website without express permission;
  • using the website to distribute unlawful content or to infringe third-party rights.

Section 5. Intellectual Property

All website content (text, images, graphics, logos, source code) is protected by copyright and is owned by TRACE or used with permission of the respective rights holder. Any use outside the intended use of the website (reading, printing for personal information) requires prior written consent from TRACE.

Section 6. Website Availability

TRACE strives for maximum website availability but cannot guarantee uninterrupted access. Maintenance and updates may occur without notice. TRACE is not liable for damages resulting from temporary unavailability.

Section 7. Liability

(1) TRACE is liable under applicable law for damages arising from loss of life, bodily injury, or health damage resulting from TRACE's negligent breach of duty.

(2) In case of breach of essential contractual obligations, TRACE is liable for typical foreseeable contract damages.

(3) To the extent TRACE or its agents cannot be charged with intent or gross negligence, TRACE's liability for all other damages, regardless of legal basis, is excluded.

(4) Liability under the Product Liability Act remains unaffected.

Section 8. Third-Party Content and External Links

The website may contain links to external third-party websites. TRACE has no control over their content and assumes no liability for it. The respective provider or operator is always responsible for the content of linked pages.

Section 9. Data Protection

TRACE processes personal data of website users in accordance with the Privacy Policy. The separate privacy policy for TRACE.App applies at app.trace-electricity.com/privacy.

Section 10. Changes to These Terms

TRACE reserves the right to modify these Terms. Material changes will be announced on the website. Continued use of the website after changes constitutes acceptance of the updated version.

Section 11. Final Provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) The exclusive venue for all disputes arising from website use is Hamburg, if the user is a merchant, legal entity under public law, or public law special property.

(3) If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is unaffected. The statutory provision replaces the invalid provision.
